Cancellation Policy
I acknowledge that if I cancel a class within 12 hours notice or no show to a booked class, or if I am late to a booked class or do not attend my maximum number of classes in any week, the full amount will still be debited from my account. I acknowledge that if I cancel a class within 12 hours notice or no show to a booked class, or I am late to a booked class this will count the same as an attended class towards my weekly visits. I’m entitled to deducting from either a class pack or from my allocated weekly membership.
IMPORTANT: Therapy Fitness reserves a strict late policy to ensure the class experience is not compromised for other members. Late comers will not be allowed into the class and a class will be deducted as a no show. There can be no exceptions to this policy.
Purchase Policy
I acknowledge this agreement is between myself and Therapy Fitness Pty Ltd. ABN: 71 650 007 248 / ACN: 650 007 248 for the above services per week (p.w.) or total number of sessions outlined. I understand that I have a 48 hour cooling off period, ending 2 days after payment should I choose to terminate this contract.
I understand that some memberships have a minimum term and that class packs have an expiry date and acknowledge that I have read and agree to the individual terms associated with this purchase.
I acknowledge that it is my responsibility to ensure sufficient funds are present in the nominated account by the due date to enable the payment to be processed on the required date. If my bank/credit card details have changed, I will notify Therapy Fitness in advance to avoid delays in processing. If there are insufficient funds available, I agree that Therapy Fitness will not be held responsible for any fees and charges that may be charged to me by my financial institution. Therapy Fitness will charge a $10 fee to my nominated bank/credit card each and every time if the payment is dishonoured.
I acknowledge that Therapy may change these terms and/or pricing at any time by providing me with 30 days advance written notice of such changes.
I agree that if my account becomes in arrears, I authorise Therapy to debit the outstanding balance in order to bring the account up to date. If my account remains in arrears, I acknowledge that Therapy may elect to refuse entry to classes or cancel all bookings on my schedule until my account is rectified
Terms and Conditions
Memberships
The payments made by me, entitle me to a maximum number of visits per week as stated in the name of this specific option. This/these classes are only valid for the one week period and do not roll over to the following week.
All memberships are set to automatically roll over to another membership period. If you choose to terminate your membership, a written (email) notification 7 business days before the membership is due to roll over is required to cancel the membership. You will be notified of this 14 days prior to this end date. Thereafter if your minimum term period and number of payments are met you can cancel in writing by email to wecare@therapyfitness.com.au within a 7 days notice period that will include one final payment amount to terminate your contract. We will respond to its receipt by written notice within 7 days.
Class Packs
The payments made by me, entitle me to a maximum number of total classes (as outlined in the specific pack). These classes are only valid for a specific amount of time and once the date of expiry passes, I acknowledge that any remaining classes are forfeited.
Termination
If I terminate the agreement or stop the automatic debit arrangement in a manner not described in the agreement, then I may be liable for damages for breach of this contract
I agree that I shall pay for all costs incurred by Therapy Fitness (including costs for which Therapy Fitness may be contingently liable) in any attempt to collect any monies owed by myself under this Agreement, including debt collection agent costs, repossession costs, location search costs, process server costs and solicitor costs on a solicitor/client basis.
Refund Policy
Our membership packages, class packages, casual classes and event tickets are non-refundable and non-transferable. Unused classes are not rolled over to the next period.
I acknowledge that if I am unsatisfied with the services provided by Therapy Fitness or believe that I may be entitled to a refund, then I will contact Therapy Fitness directly via wecare@therapyfitness.com.au outlining why I believe I am entitled to a refund.
If I cannot continue due to a medical illness or injury, I agree to provide a medical certificate to Therapy Fitness alongside a written notice.
Please note that a refund made under these circumstances will incur a 10% charge on the amount refunded to cover admin related costs.
Privacy Policy
Therapy Fitness respects your right to privacy and is committed to safeguarding the privacy of our customers and website visitors. We adhere to the Australian Privacy Principles contained in the Privacy Act 1988 (Cth). This policy sets out how we collect and treat your personal information.”Personal information” is information we hold which is identifiable as being about you.
COLLECTION OF PERSONAL INFORMATION
Therapy Fitness will, from time to time, receive and store personal information you enter onto our website, provided to us directly or given to us in other forms. You may provide basic information such as your name, phone number, address and email address to enable us to send information, provide updates and process your product or service order. We may collect additional information at other times, including but not limited to, when you provide feedback, when you provide information about your personal or business affairs, change your content or email preference, respond to surveys and/or promotions, provide financial or credit card information, or communicate with our customer support. Additionally, we may capture photo or video footage inside the Therapy premises and inside classes or at live events run by Therapy off-site. These photos and videos will utilise your image, likeness and sound of voice as recorded on audio or video tape. And without payment or any other consideration. These images may be copied, exhibited, published or distributed without the right to approve the finished product. Additionally, no royalties or other compensation arising or related to the use of these image or recording are provided. These Photographic, audio or video recordings may be used for the following purposes: Therapy Fitness related marketing and promotional purposes. And a request, in writing, to be removed from any marketing materials, photos and videos can be sent to wecare@therapyfitness.com.au . We may also collect any other information you provide while interacting with us.
HOW WE COLLECT YOUR PERSONAL INFORMATION
Therapy Fitness collects personal information from you in a variety of ways, including when you interact with us electronically or in person, when you access our website and when we provide our services to you. We may receive personal information from third parties. If we do, we will protect it as set out in this Privacy Policy.

Therapy Fitness may use personal information collected from you to provide you with information, updates and our services. We may also make you aware of new and additional products, services and opportunities available to you. We may use your personal information to improve our products and services and better understand your needs. Therapy Fitness may contact you through a variety of measures including, but not limited to telephone, email, sms or mail.
DISCLOSURE OF YOUR PERSONAL INFORMATION
We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this Policy. Personal information is only supplied to a third party when it is required for the delivery of our services.We may from time to time need to disclose personal information to comply with a legal requirement, such as a law, regulation, court order, subpoena, warrant, in the course of a legal proceeding or in response to a law enforcement agency request. We may also use your personal information to protect the copyright, trademarks, legal rights, property or safety of Therapy Fitness, www.therapyfitness.com.au, its customers or third parties. Information that we collect may from time to time be stored, processed in or transferred between parties located in countries outside of Australia. These may include, but are not limited to Australia and USA. If there is a change of control in our business or a sale or transfer of business assets, we reserve the right to transfer to the extent permissible at law our user databases, together with any personal information and non-personal information contained in those databases. This information may be disclosed to a potential purchaser under an agreement to maintain confidentiality. We would seek to only disclose information in good faith and where required by any of the above circumstances. By providing us with personal information, you consent to the terms of this Privacy Policy and the types of disclosure covered by this Policy. Where we disclose your personal information to third parties, we will request that the third party follow this Policy regarding handling your personal information.

Therapy Fitness is committed to ensuring that the information you provide to us is secure. In order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure information and protect it from misuse, interference, loss and unauthorised access, modification and disclosure.The transmission and exchange of information is carried out at your own risk. We cannot guarantee the security of any information that you transmit to us, or receive from us. Although we take measures to safeguard against unauthorised disclosures of information, we cannot assure you that personal information that we collect will not be disclosed in a manner that is inconsistent with this Privacy Policy.
ACCESS TO YOUR PERSONAL INFORMATION

A small administrative fee may be payable for the provision of information.
